Booking Terms, Conditions, Cancellation Policy, Disclaimer and Liability

These conditions set out the terms that apply for all bookings made with Vermillion Transport (hereafter known as “us”, “our” or “we”). This site is offered to you, the client, (hereafter known as “you”, “your” “passenger”). on the condition of your acceptance without modification of all terms, conditions, and notices contained herein. These must be read in conjunction with the information and advice, itineraries, rates and supplements provided by us with every reservation made with us, as well as any package holiday we provide. Any other terms will be communicated to clients prior to the confirmation of bookings in writing.

Use of this Website

This site, and each of its modules, together with the arrangement and compilation of the content found on this site, is the copyrighted property of Vermillion Transport or its various third party providers and distributors and which is licensed to the Operator. Much of the content found on this site is owned by third party providers and distributors though certain data is the copyrighted work of Vermillion Transport and other information providers. Vermillion Transport, its employees, agents, content providers, licensors, licensees, partners or affiliates, require that all the visitors to our site on the World Wide Web that provide travel related products, services and content adhere to the following terms and conditions. By accessing the Vermillion Transport site, you indicate your acknowledgment and acceptance of these notices, terms and conditions, herein referred to as the “User Agreement”.

You may only use Vermillion Transport site to make legitimate reservations or purchases and shall not use the site for any other purposes, including making any speculative, false or fraudulent reservation or any reservation in anticipation of demand. You further agree not to employ misleading email addresses or falsify information in the header, footer, return path, or any part of any communication, including emails, transmitted through this site. You agree that you shall be solely liable for any damages resulting from any infringement of copyright, trademark, or other proprietary right, or any other loss or harm resulting from your use of this site.

Responsibility

You must be of legal age (over 18 years) to create binding legal obligations that may cause liability on your part as a result of purchases made on this site. You accept full financial responsibility for all purchases made on this site.

-You must comply with all reasonable regulations and instructions made or given by us, or any member of the ship’s crew.

Force Majeure

-In the case where the carriage of passengers, luggage or vehicles to their chosen port of destination or their disembarkation from our boat, is prevented or hindered due to “force Majeure”- (Such circumstances include, but are not limited to: the destruction or damage of boat through fire, flood, explosion, storm or weather damage; accidental damage; criminal damage or any other force outside of our control)
we may at any time:

(a)Cancel the voyage
(b)Alter the usual route
(c)Delay the ship at or off any port or place
(d) Put onto any ships or land the passengers, luggage or vehicles at any port or place and forward the same to their port of destination by any means of transfer whether or not belonging to us, by any route, without being liable for any loss, damage or expense sustained by the passengers, luggage or vehicles.

Variations in services

  • A ship may tow or assist ships in all situations.
  • Within reason and with the passenger consent, we may transfer any passenger from any seat other accommodation reserved by that passenger to another of the same class and price.

Refusal to carry and refunds

  • No refund will be given to passengers who are removed from the ship due to abuse of alcohol or drugs or unruly behavior towards fellow passengers of our employees.
  • No refund will be paid unless the application and ticket is submitted within xx days of the date of the ticket.
  • No refund will be made for tickets claimed to be lost, stolen or destroyed
  • We refuse to carry any unaccompanied children who, on the date of travel are under the age of xx years, unless accompanied by an adult of at least xx years of age.

Medical Conditions, Disability and Pregnancy

If you are suffering from known or suspected medical condition which makes sea travel inadvisable on medical grounds, disabled or more than 28 weeks pregnant, you are required to notify us of that condition and to produce a valid medical certificate confirming fitness to travel.

Luggage

  • Passengers traveling in inter atoll ferries, shuttle transport, Atoll Ferry, Province Ferry, Charter Speed Boats are allowed maximum XX kgs luggage.
  • All luggage must be properly packed. We shall not beliable for any loss, damage or expense arising from the passenger’s failure to comply.
  • If any luggage entrusted to us for loading, unloading or carriage on or from the boat remains unclaimed on arrival at its destination, the luggage may be stored in an appropriate warehouse until called for. We may make a reasonable charge for storage, however we shall not be liable for loss or damage to the luggage stored in such situations.
  • All luggage and other property found by a passenger in or on any of our transport vessels or premises is in the possession of us and must be given immediately to one of our employees.

Dangerous Goods

  • Inflammables (including matches), explosives, corrosives, firearms, and all other articles which may involve undue risk must not be packed in luggage.
  • We will not accept on board any dangerous goods for carriage except in special circumstances and under special conditions.

Animals

  • We shall not be liable for any loss, damage or expense suffered by or relating to the carriage of animals however caused.

Vehicles

  • All vehicles should be parked with the handbrake engaged and left in gear.

Surcharges

All prices are quoted in United States dollars and any fluctuations of prices due to government action or other similar cause may result in a surcharge being imposed.

Payment

We require payment in full after confirmation by credit card.
We accept Visa, MasterCard & American Express cards.

Insurance

You are recommended to ensure, when making your reservation that you and your party are insured against all relevant risks, including all locations and places you intend to visit throughout your holiday.

Credit card payment

We will charge your credit card 100% of the amount your reservation represents after sending you the Hotel Voucher. In order to charge we will use the credit card details supplied at the time of booking or as soon as we receive the relevant details, documents and the completed credit card Authorization form by Fax or other.

Credit Card Refunds

Vermillion Transport is committed to providing an efficient refund procedure. Refunds will be made in the form of a credit refund. I.e. we will credit the amount charged, minus any cancellation fees (if applicable), to your credit card. Once the refund instructions have been issued to our Merchant Bank, it can take anywhere from 15-45 working days for the proceeds to show up in your account. The amount refunded will show on your printed credit card statement for the next billing cycle or on your online account (usually faster).

Vermillion Transport Reservation Guarantee

The Vermillion Transport Booking Guarantee covers all reservations and bookings made through us. If your confirmed booking is not available at the Hotel for any reason at the time of check-in, please immediately contact Vermillion Transport. We will arrange accommodation at a comparable hotel and pay for your first night’s stay, including any tax and service charges. We will also pay for all communication with our office when provided with receipt for your costs.

Your rights if we cancel

We undertake to inform you without delay if we cancel your reservation due unforeseen circumstance, such as fire at hotel, natural disaster, overbooking or etc. In such we will offer you an alternative of at least a comparable standard (if one is available) or a full refund of the payment.

Our liability to you

We accept responsibility for ensuring that the services we deliver to you are of the highest standard possible.

Personal injury

We accept responsibility for the negligent acts and errors of our employees. We cannot, however, be held responsible for any other circumstances that lead to the death, bodily injury or illness of you or any other individual.

Client service

If you have a complaint or are unhappy with the services provided, please make it known as soon as possible, either to the management of the accommodation or to us. Please provide the fullest details as early as possible. Every effort will be made to arrive at a fair and satisfactory conclusion for the best of all involved.

Cancellation by you (Cancellation Conditions)

Please note that we will only charge a cancellation fee for confirmed reservations. If you cancel a confirmed reservation, you are subject to a cancellation fee. The general cancellation policy below applies to all reservations unless the hotel or wholesaler have different policies. It’s compulsory & your duty (the traveller’s) to be aware of any applicable cancellation charges at the time of booking. Please ask for cancellation policy and charges for that particular Hotel at the time of booking.

These policies will then take precedence over the general cancellation policy stated below.

Cancellations received less than 14 days before arrival – 15% of the total.
Cancellations received less than 7 days before arrival – 01night’s accommodation charge.

There will always be an administrative charge of 10% of the total amount, if you cancel a reservation, in addition to the cancellation charge (if applicable).

Important to Cancellation Conditions

Different Hotels follow different cancellation policies and charges vary at different periods of the year. Especially during Christmas, New Year & high seasons, the cancellation charge is 100%, for cancellations within 30 days of arrival. So once again, please make sure you are aware of the cancellation charge for your particular reservation before you confirm & make payment with us.

Changes by you

If you want to make any change to your confirmed reservation please send us an-email with all details. Your requested Change will ONLY be valid, when you receive an e-mail confirming the change from Vermillion Transport. If the requested change of a confirmed booking is made during the cancellation period, it will be treated, at our discretion, as a cancellation. Please refer to Cancellation Conditions.

Failure to Check In At the Hotel & Early Check Outs

Failure to check in at the hotel as per confirmed booking (Hotel Voucher) will be treated as a late cancellation and cancellation conditions apply.

Similarly, if you need to shorten your stay and early checkout, we will try our best to refund the unused room nights UNLESS NOTIFIED OTHERWISE BY email.

Please inform us in advance and cancel the unwanted room nights, or else you will not receive the refund for the unused room nights.

Literature and brochures

We have taken every reasonable precaution to ensure that the information provided by us is fair and correct at the time it was supplied. However, as we do not own the accommodation, we exclude liability for subsequent alterations and the withdrawal and amendment of facilities (whether due to climatic conditions, vandalizing or abuse, cleaning, repair or legal, regulatory, seasonal or other local reasons).

Third party exclusions

Transportation and accommodation of clients are subject to international conventions, which override any contract, expressed or implied between our clients and us.

We cannot be held liable if any client is refused admission into the countries they are visiting.
The possession of valid passports, and/or other required travel documents, such as airline tickets and hotel vouchers at the proper time, is the sole responsibility of the client.

Liability for the failure of any client to observe the law of the countries they are visiting is excluded. We will not be held responsible for any delay in transferring of clients or any other delay under such circumstances.

General Terms and Conditions

We strongly urge everyone to read and agree with the terms and conditions before making any reservation through Vermillion Transport.

If you disagree with the Booking Terms and Conditions in any way, please inform us before confirming any reservations with us. Similarly, we reserve the right to change the Terms and Conditions at anytime. Your continued use of the Vermillion Transport (WHD) website, or receipt of such changes by email or in writing, following the posting of changes to these Terms and Conditions constitutes your binding acceptance of these changes.

Vermillion Transport (hereafter known as “us”, “our” or “we”) make every effort to ensure that all information and rates on our various websites are correct. However, due to unforeseen circumstances after the information and rates were published, some of the information and rates may no longer be valid. We therefore disclaim any warranty, representation or undertaking in relation to the completeness, accuracy, adequacy or quality of the content on our websites.
